What are the five roles of the prosecutor in criminal courts. Briefly describe each role. Is it necessary for the prosecutor to work closely with police officers to determine inculpatory evidence?

Prosecutors have various important roles to play within the criminal justice system, including five basic functions that collectively help in the pursuit of justice. The first role is screening and making charging decisions which involves carefully evaluating the evidence presented by law enforcement as a way of determining the viability of pursuing criminal proceedings. Factors such as the strength of evidence and the severity of the offense greatly contribute to this decision-making process.

After deciding to prosecute, prosecutors then move to the exhaustive process of case preparation. The activities in this stage involve gathering evidence, interviewing witnesses, and formulating legal strategies. Their deep understanding of procedures involved in the criminal law process enables them to construct compelling cases to be presented in court. Once they reach the courtroom, the prosecutors take the role of being legal representatives of the state, where they present evidence, examine witnesses, and articulate legal arguments to assist in establishing the guiltiness of the defendants (Monahan et al., 2020).

Apart from their role in courtroom advocacy, they are also involved in the process of plea bargain negotiation. This entails doing assessments on the strengths and weaknesses of a case, considering the criminal history of a defendant, and negotiating agreements that serve the interests of both parties (Monahan et al., 2020). In addition, prosecutors also have post-conviction responsibilities which include participating in sentencing hearings, advocating for appropriate penalties, and addressing post-conviction issues such as appeals.

Collaborating with law enforcement is crucial to the role of prosecutors, especially in determining inculpatory evidence. Prosecutors rely on the unbiased and thorough investigations conducted by police officers to build a robust case (Bellin, 2020). Cooperation between prosecutors and law enforcement through effective communication enhances the quality of evidence and results in just and fair outcomes in the criminal justice system.
