The transition to the United States Constitution from the Articles of Confederation was not always seamless. Fixing the issues of the Articles of Confederation needed a series of long debates during and after the convention took place. The one that was certain was that changes had to be made. Fifty-five delegates convened in 1878 at the Constitutional Convention to assess the best ways to rectify existing documents. Some of the weakness of the articles was that they lacked a national court system, every state was allocated a single vote regardless of size, and lack of an executive branch to enforce acts that Congress passed. Another weakness is that congress lacked the mandate to tax or regulate interstate and foreign commerce. Also, laws need a nine out of thirteen majority to be passed in Congress and amendments of the articles needed a unanimous vote. These loopholes brought a great deal of conflicts between states, something that delegates tried to resolve by drafting the Constitution. However, when the Founding Fathers finished signing the constitution, under the Articles, it required ratification from nine states before going into effect, which was not easy. The push for ratification sparked a seemingly endless barrage of articles, documents and pamphlets opposing and supporting it.

There were two sides to this debate: Antifederalists and Federalists. The Federalists were pushing for the ratification of the Constitution, while Anti-Federalists were against it. One of the significant issues that the two parties were not conflicting about was the inclusion of the bill of rights. To the Federalists, the addition was not necessary as they believed that as is the Constitution stood for limited government rather than the people. The Anti-Federalists on the other hand were of the opinion that the Constitution provided the central government excessive power and people would be exposed without the Bull of Rights.

The Split of Government between Federalists and Anti-Federalists

The Federalists who were led by Alexander Hamilton, although secretly were the first political party to form in the United States. Federalists supported the Constitution and tried to convince the States into ratifying the document. Alexander Hamilton alongside James Madison and John Jay, published a series of essays anonymously under the pseudonym “Publius” that were regarded as Federalists Papers (Gilbertson, 255). Madison and Hamilton argued that the Constitution did not need a Bill of Rights as it would cause a parchment barrier that would limit people’s rights rather than protecting them. However, the two eventually formed a concession and announced their interest to take up the issue of the series of amendments that would eventually become the Bill of Rights. Without such compromise, the Constitution might never have gotten ratified by States. It is surprising that it was James Madison, a Federalist that eventually showcased the Bill of Rights to Congress irrespective of his former position on the matter.

In the great debate concerning the ratification of the constitution, the Anti-Federalists were opposed to the new system as it did not protect individual rights and threatened liberties. While the anti-federalists were not always united, they involved various elements. One section did not support the Constitution as they thought that more powerful governments had threatened the sovereignty of sports. Others opined that a new central government would possess the traits of the despotism of Great Britain they had strived hard to separate themselves from. Others were still afraid of the new government threatening personal liberties. In the push for ratification, majority of the articles that were in opposition were given pseudonyms such as “Centinel,” “Brutus,” and “Federal Farmer” however renowned revolutionary figures such as Patrick Henry came out publicly against the constitution. Although the Anti-Federalists were not successful in keeping the Constitution from being adopted, their efforts were responsible for the development and implementation of the bill of rights.

Jefferson and Hamilton’s Debate over the Role of the Federal Government versus the State

Following months of compromises and battles, the United States Constitution was eventually sent to Congress by the Convection on September 1787. Throughout the first decade and the ratification process in the first decade of the new government, the American society was at the center of a heated argument about exactly the way governments would function and the kind of powers they could have. Political parties started developing soon afterwards as people argued about the direction in which the discussion was headed. Alexander Hamilton soon became the leading voice for the Federalists who strongly opined that the federal governments were supposed to be strong. On the contrary, Thomas Jefferson who was a Republican argued that trusting the federal government would cause tyranny. A clause in Article 1 of the constitution gave Congress the power to make provisions and laws which would not be categorized as enumerated powers. Jefferson and Hamilton debated numerous times about what ‘necessary and proper’ would mean. Hamilton adopted a more liberal reading of the clause and pined that Congress thought do what they deemed necessary for national responsibilities, Jefferson, in the other hand, maintained that the clause indicated that Congress should only take actions they deemed absolutely necessary and nothing more (Mikhail, 507). Hamilton proposed the US charter should have a national bank to cater to the Revolutionary War debt, stimulate the economy, and develop a single currency. Jefferson on the other hand argued that the development of a national bank was not proper and necessary. After presenting both arguments to Washington, he agreed with Hamilton’s viewpoints.

Promotion strategies such as advertising are not only effective but also culturally sensitive. By providing a wide range of products, Woolworths ensures that it offers the client a variety of products and services from which they can choose from. The leaders have made multiple attempts to fix Tessei’s managerial control and monitoring problems, but none has been successful. Yabe seeks to adopt a new creative approach to address the problem.

Some of the critical challenges facing Tessei include customer complaints, employee recruitment and high turnover, and operational mistakes. Customer complaints are caused by the high expectations that Shinkanshen passengers have of Tessei Company. Worth noting, the customers received high-standards services such as perfectly clean spaces which were well-coordinated in seven minutes. Besides these, the clients expected that they would get the forgotten items on the train, which was impossible. Additionally, the customers complained about unkempt bathrooms on the train. The 7 minute standards order put the employees under pressure, yet most of them were above the age of 40, inexperienced or new. This makes it difficult for them to do the cleaning in a standardized yet rushed manner. The time was barely enough to clean all the available coaches. The result of this is that it led to frustrations and lack of motivation among employees, which explains the high turnover rates.

As regards operational mistakes, Tessei was forced to come up with ways to reduce costs as much as possible. The expenses were weighing in on them, and if they failed to take action, they would have been out of business. To do this, they resulted in reduced use of soap in the cleaning process. The issue de-motivated the employees significantly and they ended up leaving the company. Whenever employees tend to leave an organization at high rates, it weighs in on their human resources. Some tasks end up not being completed because of the shortfall of workers. If the issue is not addressed hastily, it can permanently affect the company, leading to closure. Managers also feel the effect because they experience a shortfall of manpower in their respective departments.

From a general perspective, culture is the cumulative deposit of aspects like experience, knowledge, attitudes, beliefs, religion, values, meanings, roles, concepts and possessions amongst others that are acquired by a relatively large group of people and passed on through generations individually or through groups depending on the specificity of people. The adopted behavior and way of life from the initial ancestors is learned and with accumulation of experience it is subsequently passed on socially and acts as a symbolic means of communication.

In some instances, culture may be shared between two or more groups in that they have some beliefs, religion or values in common. This would also act as a bridge connecting the particular groups involved because it makes them think something must have caused them to have the same opinion or stand about certain cultural aspects. Religion for example gives a more vivid picture and explanation for shared culture. Religion is the belief of a link between humanity and the spiritual world. In Saudi Arabia the official religion is Islam and the Kingdom’s law obliges every citizen to be Muslim. Freedom of religion does not exist in Saudi Arabia and practice of any other religion is highly prohibited. For this reason they have a group of religion “police” who enforce the restriction of public or private practice of any other religion in their country. The Islam religion is known to be practiced in very many other countries including Iran, Iraq, Pakistan, Bangladesh and Sudan among others. This means that the religion aspect in the culture of Saudi Arabia is also shared by other countries’ cultures as well. The facet of shared cultures may act as a thread linking the countries or groups back to either one origin or ancestry in some cases.

In Saudi Arabia, both men and women are directly dictated by their customs and religion to dress conservatively. In the case of Saudi men, thobes which are traditional dresses are won despite the social status or the job occupation of an individual. Other than the thobe being appropriate for the hot climate in Saudi, it also expresses equality among them. Saudi women on the other hand wear cloaks called abayah and are mostly black. They then cover their hair using a scarf and a veil that fully covers their face except for the eyes. They are supposed to dress like this in public and around people who are not their close relatives. As for teenagers they should not wear tight jeans or any clothes showing parts of their bodies. Foreigners are also indebted to abide by local customs especially in public areas. In the 1980s the Kingdom banned movie theatres to prevent immorality and westernization. However the ban is currently in the process for liberalizing to allow for development of their cinema however certain television shows, films and DVDs are prohibited. An exception is given if they have censored scenes with immorality or directly offending the government or the royal family.

Even with the Saudis being well informed in the Arab and Muslim world, the government does not recognize freedom of the press and publicizing ones opinion. Any stories or speeches given in public should not contradict the Islam traditional values or the Saudi government rule. It should also not directly offend the officials of government or the royal family in particularly. Political parties and labor unions are prohibited in Saudi Arabia. However informal discussions on the public policies are not deemed illegal, they are not promoted and action is taken to participants if they endorse disloyalty or immorality. Creation of a Consultative Council by the government has allowed for the existence of certain societies but they have considerably little ability to manipulate or change the policies up held by the government. The national dance in Saudi Arabia is known as Al Ardha and the sword dance is founded on their ancient traditions. It is a rhythmic blend of drum beats, chants and men dancing using the swords they carry to create an entertaining movement. Another prominent form of music is the samri in which poetry is performed through a song and people dance to it.

The absorption of one culture into another group of people or a country at large is known as culture learned. This could be because the culture is of significance in the lives of the country that is absorbing it. An example of culture learned in Saudi Arabia would be cinema. In the past, it was banned completely from publicity in their country. They believed it did more bad than good and lead to high measures of immorality. However, something later on changed their opinion and they decided to reconsider and ease up by allowing cinema but with certain restrictions. This clearly explains that even after their perception of cinema, with time they learned on how to allow its publicity while limiting what they feared which spreading immorality is.

Saudi Arabia is considered as one of the countries with a very unique culture because it has upheld their initial beliefs to this moment without allowing for deviation from them. This portrays an image that they respect their culture and even with its spread through every generation they do not change any aspect of it but consider it the normal way of life.

Makenna Goodman’s article titled Ever Wonder if You Could Kill What You Eat? We Did the Other Night is about how killing the animals that people eat make them feel. The author also uses logos when she says that the joy of having many people around is that no one sits around without pitching in. This is true because people always help with tasks around. The use of logos is effective in showing the need to know the backstory of animals.

For example, it is very easy to know if a person from Dubai is there for a meal or note. For those who want a mean and are really in need they always have a rush behavior when asking for the meal, but they do not want the mean they on the other hand tarnish the meal. However, this has changed over the years whereby the people of UAE are very hospital and this is a national culture intended to increase tourism in the country. The people of today, have a catchy behavior when asking for meals at homes and even in the hotels or restaurants. For the sake of this paper, the behavior will be analyzed based on those in business places. Today, they humbly ask for meals, at hotels. The other culture is when the people enjoy the means. When the people enjoy means them behavior differently. For example, the male will ask for more of the food, while the women will thank the management as ask to purchase take away meals for their kids if they were not with them. In addition, the people come back to the restaurant when they enjoy the meals. For a business case, the people just leave the business if they do not want east meals or make several excuses.

The culture of UAE has various communications patterns embedded in one on one communication between individuals and between groups. Use of gesture is one of the communication patterns used by the people of UAE. However, there are several gesture and behaviors that are considered offensive to the people. Pointing at some with your hand is one of the gestures that is not accepted by the people of Dubai and UAE at large. In business, it is always not right for the businesspersons to look down while taking to the customers. In addition, shouting at some is a behavior not acceptable by the people of Dubai. In a meal, it is clear to the people of UAE that taking meals and talking is not permitted and is considered a taboo to the people. Sneezing while in a group of people without covering the nose is also considered as unethical behavior amid the people of UAE hence considered offensive. Women are not allowed to shake their body in front of the public in UAE. This is considered as against the culture of the people. Spitting carelessly in the public is a behavior note permitted by the people of UAE hence considered as an offensive behavior.

Gender

There are two different scenarios when it comes to gender issue in business in the UAE. The customers of UAE are in two groups the elderly and the youth or the generation Y. To the elderly, it is evident without doubt that the elderly are not for that men and women have the same right when it come to business issues. They considered the women a subordinates. For this reason, it is advisable that such clients are treated based on this culture in order to retain them as your clients. In such as case a male clients of that age should be handle with a male staff and so does a female client of that elderly age.

On the other hand, the generation Y, are not there discriminating gender. They consider male and female as equal when it comes to business. This is so because, even the current arms of government are there supporting women right hence taking part in business equally to men is one of the rights. Therefore, the existence of the mixed culture on male and women take in business demands the entrepreneur to differentiate the two groups when making business in order to maximize sales.

I believe we all know that Vietnam is a multiethnic nation with a total of 54 tribes. This makes it a dynamic and culturally rich society. As Confucian followers, the Vietnamese are really devoted people who deeply observe the stringent Confucius ethical standards Jahn, GC. (2006).

For the Emiratis to succeed in their business activities in this country, they must learn the various aspects of Vietnamese culture. If they understand their cultural different, they will be in a better position to fit in without any problem (Herring, G.C., 2007). Some of the major aspects of the Vietnamese cultural practices that directly influence business include the following:

The Emiratis should begin their operations by establishing personal relationships with the Vietnamese. It is a communication norm to begin any transaction after building a very strong rapport (Murray, G., 1997).

All the business communications should be formal. The Vietnamese are so suspicious about foreigners. So, for the Emiratis to ensure that they are fully endorsed, they must ensure that all their deals are formalized.

It is the culture of Vietnamese to maintain loyalty and trust in their business operations. Therefore, when making communications, the involved parties must be truthful and fulfill all their pledges. Otherwise, they will contravene the Confucius doctrine of responsibility, obligation and benevolence.

When carrying out international communications, the Emiratis must ensure that they show regard to the elderly. This means that the decision of the old people should not be questioned. People should be respected not based on their education or experience, but based on their age (Peter C. P., 2005).

In conclusion, I would like to agree with the fact that Vietnam has lots of business opportunities that should be exploited. However, the foreign investors such as the Emirs must be well conversant with aspects of their culture. if they act this way, they will succeed in their business activities.

Tracht is a local term in Germany used to refer to the country’s traditional cloths, hairstyles, beards and accessories. It is a common term among the Germans and a tradition related to this country. Leather knee-length trousers commonly identify tracht among men in German. Alternatively, they can wear short pants made from the same material together with wool socks along with rustic shoes. Women also have their attire under the same group of traditional clothing. Tracht among women includes the dirndl, which is a huge full-length skirt of dress (Gordeeva, 2012). This is worn alongside a bodice, which is a closefitting attire and an apron to complete the women’s tracht. Hats are also a common part of the complete tracht outfit.

Traditionally, the tracht was common among all Germans, but times have altered the dress code in most parts of the country. Currently, the tracht is associated with people residing in the southern part of Germany. For example, people from Bavaria and Munich still value this dress code as a prestigious wear. As such, the tracht is not an everyday costume for people to wear, but rather a ceremonial dress. It commands respect and value for tradition among its wearers. For example, people attending wedding ceremonies often find it fit to wear the tracht (Tiffany, 2012).

Tracht is a costume associated with traditions and not religion. Back in the days, everyone wore a tracht from men to women and children. However, it was highly associated with various characteristics in the society. In earlier times, it was a tradition kept with the aim of identifying the various social and legal groups in society. For example, married people could be identified with the way they dressed, and so could the single people in the community. Law enforcers in the society and judges were also identified by the tracht they wore whilst among other citizens.

The reason behind the wear during the olden days was keeping up with traditions. People had to have a distinct way of identifying each other in the society. For example, single individuals, married and divorced people were social statuses that were distinctively determined by way of dressing. Currently, modernization has revolutionized the way people dress and the tracht are among the least worn cloths in Germany. People wear the tracht in ceremonies for modesty purposes. Its significance as a traditional symbol is still thriving among the German people. Visitors to the country often identify the tracht among the dress codes they would expect to see many people upholding. Conversely, it is more of a common practice among people in the south of Germany than in the urban areas (Munich Found, 2004).

The tracht as aforementioned is a dress code that roots its source to the traditional days. During this time, German’s citizens considered it as a crucial wear that spoke volumes about their cultural practices and had identification among the people. Although the dress code was overridden by modern ways of dressing, it is still a vital part of German traditional practices (Tiffany, 2012).

In order for an individual to be properly assimilated into a new culture, she should reject the traditions and culture of her previous country and concentrate on those of the new country. Wearing items that identify an individual with a culture outside his or her adoptive country slows down the assimilation process, or worse, alienates the individual from his or her adoptive society. The statement is in reference to a case where one migrates to a new country or region, and the culture is different. I partially agree with this statement since one has the capability of accommodating new cultures while at the same time retaining previous ones. For example, in my case, I would want to retain a culture of wearing cloths bearing my country’s name. It is significant for me to preserve this culture to avoid losing my cultural roots. Indeed, if I were denied this opportunity, I would be disappointed since I would be losing an integral part of me.
